On November 26, 2009, the Impact on Communities Coalition, a group that was talented for riding the fence when it came to the Olympics, organized a forum on the impact the Olympics would have on Civil Liberties in Vancouver. What they managed to do is get Bud Mercer and Steve Sweeney in the same room as people like David Eby from the BCCLA and Alissa Westergard-Thorpe from the Olympic Resistance Network and the 2010 Welcoming Committee. The thing is that during this time, the Vancouver 2010 Integrated Security Unit - Joint Intelligence Group was also in the process of spying and harassing activists during this time, and going through everyone's trash. They also managed to get Bob Cooper, who was with VANOC. This is interesting, since ORN was often excluded from panels because VANOC and the V2010ISU-JGO wouldn't be on the same panel as ORN.

We know that the event ended with David Eby reading this public letter and walking out, and people heckling Bud Mercer, Steve Sweeney, and the head of the ISU engaging in a shouting match with Garth Mullins and other activists from ORN.

So, the obvious question is how did this happen?

I requested documents, because I believed that Bud Mercer would have been given the intelligence briefs on ORN and all the people who they thought would have been seen at that event. I was at the event and I expected my name to appear there. What I ended up getting were some of the contents of Bud Mercer's inbox. There's not a lot of info here, but it should be noted that Alissa was listed simply as an Olympic Critic the entire time her name is mentioned, and she is also not even mentioned on this panel.

It's interesting that the Community Relations group is involved in this and not the JIG. What's funny is that Steve Sweeney anticipated that they would be ambushed by ORN and others, and Am Johal also warns against the heckling, so it's clear that Mercer and Co knew they were going into a hostile room beforehand. That being said, I do think this shows the complete disregard for the JIG intelligence reports.

Of course, the last e-mail is Am Johal apologizing for everyone who was rude to Bud Mercer and Steve Sweeney. Overall, the main thing that is striking is the lack of JIG documents, especially since this is listed as an incident in PRIME and I have a file in the PRIME database that was filed...

I recently asked and received copies of the Completed Access to Information forms from Public Safety Canada:

  • A-2010-00209 - Records concerning a potential border security agreement with the United States, authored between July and December 2010
  • A-2011-00143 - Recommendations following a cyber attack that led Defense Research and Development Canada to shut down one of their servers.
  • A-2011-00220 - All records from March 1 to November 4, 2011 about Canada's privacy commissioners' positions on the proposed lawful access bills
  • A-2011-00319 - Emails drafted, sent and received between Feb. 15, 2012 and Feb 21, 2012 regarding the Twitter user VikiLeaks30
  • A-2011-00320 - Emails drafted, sent and received between Feb. 15, 2012 and Feb 21, 2012 regarding the Twitter hashtag #tellviceverything
  • A-2011-00322 - Briefing notes between February 15, 2012 and February 21, 2012 for the Minister on Bill C-30

The first file is the largest and goes through the negotiations for the "Beyond the Border" action plan. I haven't read through the whole thing yet, but it's definitely worth the time going through it and finding information in that document regarding the new passports that are supposed to be issued in 2013. (It was supposed to be this year, but I'm guessing budget cuts took care of that).

The second file is a Canadian "Cyber War" document which talks about how Public Safety Canada is the lead agency when it comes to Canada's Cyber Warfare strategy. This should frighten people since these idiots can't operate a can opener. However, there's a nice set of slides by DND which talks about what they think "Cyber War" is. It's amazing how much effort can put into a term that was made up as a part of SCIENCE FICTION. I definitely want to get a shirt that says "I'm a part of Red Force" or "FUCK BLUE FORCE". #OccupyCanada, Anonymous and the Integrated Terrorism Assessment Centre

Last year, I requested documents about the #Occupy movement in Canada, as well as documents on Anonymous from the CSIS Integrated Terrorism Assessment Centre. This was to determine whether CSIS was monitoring Anonymous or the various Occupy encampments that were in Vancouver, Calgary, Ottawa, Toronto and Montreal. It seems that they were monitoring it, but there doesn't appear to be much here that they couldn't find on the Internet.

We've had files from ITAC before about the Olympics and the G20, so it made sense to start there. The change in language from "Threat" to "Terrorism" implies that Canada considers the Occupy movement and Anonymous terrorist groups, since why else would a Terrorism Assessment Centre have documents about them.

The Occupy documents first start with the first notice regarding the call-out. It should be noted that this call-out was based on "Open Source" intelligence, which means they saw it on the Internet just like everyone else. Then there's this weird almost totally unrelated document about Muslims Against Crusades demonstrating on Rememberance Day. This follows with the old Anonymous video that threatened Rob Ford if OccupyToronto was evicted.

The final report is about the Occupy The Port protest that happened back in December. What's interesting is the fact that the RCMP is telling ITAC about the fractured nature of "OccupyVancouver", which implies that the RCMP themselves have been also monitoring OccupyVancouver and in fact this may have been part of an Occupy Joint Intelligence Group. I have already sent a request to the RCMP asking for info on the Occupy JIG, but I haven't heard anything about it yet.

The Anonymous one is shorter, but a bit more interesting. It first refers to an operation called Operation Green Rights as a threat to the Oil Sands. It also talks about nuisance activities during Guy Fawkes Day, known as Operation Injustice Awareness, the earlier mentioned Toronto video, as well as an Anarchist call-out against Stephen Harper.

This report mentions No One Is Illegal, NOWAR-PAIX and Convergence des luttes anti-capitalistes (CLAC), and draws on the previous intelligence gathered by the G8-G20ISU-JIG. Apparently there was in invite to Anons and a website filestack.ca that just has a picture of a...

The Surveillance against Camas and Spartacus

The Vancouver 2010 Integrated Security Unit early on did surveillance of Spartacus Books. It had the old address before the fire. We can see this get updated, and the V2010ISU made sure to grab the old ALF and ELF material that the store had. It's interesting to see what they said about Spartacus Books, namely that it wasn't a target because of the longevity of the store, but they still treated it as such anyway. Apparently someone advised against bugging the store, which I found rather interesting. Therefore, the majority of the surveillance of the bookstore was outside it.

What is interesting with this document is how I managed to get on the radar. It appears that the Victoria Anarchist Bookfair in 2008 was where they got their target list. They singled out the Vancouver and Victoria based vendors, and they show the various bookstores they visited, which included Dark Horse Books. It seems that the CBSA was involved with the V2010ISU-JIG early on with the Intelligence Officer Kelly Sandhu actively participating in the activities of the JIG. Also, it seems that the Victoria Kool Aid society knew about the JIG investigating, since the RCMP and CBSA got a tour of the venue before the bookfair occurred.

Also, the documents about Camas confirm that the first photo of me from 2008 was taken by IO Sandu, and that they were set up outside the bookfair and seeing who was going in and out of the bookfair. Later, one of the members of ISU decides to buy some zines from Camas for intelligence purposes. It seems that the CBSA was very involved in the surveillance of NO 2010 Victoria. Unfortunately, the records on Camas are incomplete.

Spartacus, on the other hand, due to my involvement has far more information. It seems that IO Sandu visited Spartacus Books. This was back in 2007 at the old 319 West Hastings location. Following this, the JIG decided to do impromptu visits of the bookstore. It seems that the surveillance of the old store was cut off on February 2008. It seems that later in 2008, the JIG took pictures of people who they believed were part of the Spartacus Collective and kept track of them.

After that, there is the lengthy file on my activities which are boring. They decide that I'm an APC member, despite the fact that I've never attended a meeting. They follow me around to Coffee Shops, take video of me going to lunch with co-workers, and even follow me into 7-11. There are other interesting facts...

I requested information on Lawful Access back in November from CSIS from the period of September 2011 until November 30, 2011. Once again, the use of Cabinet Confidences to amend the request to near uselessness didn't help much, nor did the waiting period.

My request reads "All briefing notes to the director and/or to the Minister concerning "Lawful Access" legislation for the period September 2011 to November 30, 2011"

It seems that the memo addresses the concerns of the telco industry, and refers to the consultations that took place back in 2002, 2005 and 2007. This indicates that there were consultations since 2007, which should show how wrongheaded this bill is. CSIS also discusses CALEA, and how it is the US equivalent law. What it doesn't mention is the fact that this led to a 62 pecernt growth of wiretaps, and over 3000% growth in the interception of Internet data, which shows that this is ripe for abuse.

There are details of what the ISPs should and should not be required to do as well. Basically, the Government will give them a prescribed amount and the ISP will then go out and purchase the equipment that works with their network. This means that the ISP could go out and buy the cheapest piece of gear and pocket the rest of the money for all we know. However, they have to make the minimum number of interceptions. It seems that after reading it, it's clear who the inspectors are, and that the inspectors will come from CSIS.

Seriously, CSIS should not have the ability to just waltz into a data center and perform an interception without a warrant just because they want to do tests. Also, CSIS is the least trustworthy agency in the Government of Canada, since many Canadians don't know who they are and others squarely distrust them because of old tales of them spying on someone they know and ruining their lives.

Anyway, here's the memo. I'll hopefully have something more substantial soon.

I decided to ask about the VMC, and even though I know that there is a lot more information, I managed to get this from the RCMP without having to get the permission of the individual contributors.

It appears that the surveillance of the Dominion started in 2008, although this isn't clear from the document, and that the Dominion itself was a task, similar to how individuals were tasks. However, the documents just show the RCMP conducting Open Source Intelligence on the upcoming releases of the documents, which makes sense since the RCMP are probably one of the most dedicated readers of the Dominion and the Media Coop.

The redactions on this are interesting,since they hit 16(1)(a)(c), 16(2) and 19(1) of the Act. 19(2) is the familiar protection of privacy clause where other persons of interest are obscured, but here's 16(1):

16. (1) The head of a government institution may refuse to disclose any record requested under this Act that contains
(a) information obtained or prepared by any government institution, or part of any government institution, that is an investigative body specified in the regulations in the course of lawful investigations pertaining to
(i) the detection, prevention or suppression of crime,
(ii) the enforcement of any law of Canada or a province, or
(iii) activities suspected of constituting threats to the security of Canada within the meaning of the Canadian Security Intelligence Service Act,
if the record came into existence less than twenty years prior to the request;

(b) information relating to investigative techniques or plans for specific lawful investigations;
(c) information the disclosure of which could reasonably be expected to be injurious to the enforcement of any law of Canada or a province or the conduct of lawful investigations, including, without restricting the generality of the foregoing, any such information
(i) relating to the existence or nature of a particular investigation,
(ii) that would reveal the identity of a confidential source of information, or
(iii) that was obtained or prepared in the course of an investigation; or
(d) information the disclosure of which could reasonably be expected to be injurious to the security of penal institutions.

So, while we're not being slammed by the notorious 16(1)(b), we are stuck with a large amount of information that is redacted. At any rate, here are the documents...

It seems to never end. I got a less redacted version of the V2010ISU-JIG reports, and I currently have the following reports:

These documents are far more complete than the earlier documents that I got about myself. For starters, they show the phase that the RCMP thought I was at when they were conducting their surveillance. According to the RCMP, on February 2009 I was gathering equipment, weapons and getting legal defence set up. Now, everyone should be concerned about this, since I wasn't gathering any weapons or equipment at that time, and there's also the fact that even if I was talking to a laywer, that's my right to do so. Furthermore, they have me listed as a threat alongside PETA to the games. This goes along with the logic of 'if you have done nothing wrong, you have nothing to hide'. The fact is that even if you engage in non-violent civil disobedience, or even peaceful protest, it's ALWAYS a good idea to have legal support, and talking to a lawyer should NEVER be used as evidence, since everyone has the right to speak to their lawyer.

The fact that we have to discuss whether talking to a lawyer is grounds for suspicion is ridiculous, since asking a lawyer advice on something like "Do you think this will be illegal?" isn't illegal. When the police and the state make demonstrations illegal, as they have tried to do during the Olympics and the G20, this is due diligence.

The files are posted above, and as usual I redacted my middle name and my birthdate, but other than those details, these files are exactly like those that were given to me by RCMP ATIP. I have sent an e-mail to the RCMP about this, and hopefully they comply when a 3rd party requests these same files. I hope to get more intelligence reports, briefing notes and other material soon.

The CBSA has been listing their ATIP responses for a while now, and this means that I was able to receive existing responses for free. We have files detailing the CBSA's Intelligence Gathering practices, which include information on targets and how they spy on them. The information is quite extensive, and I can't cover it all here, but I'm still going to try regardless.

The first file we have is related to the CBSA entering Women's Shelters to deport people from Canada. This has the basic information that was directly related to the case where the CBSA were entering Womens Shelters in Toronto. The second file is a file that appears to be from Atlas, whih is the CBSA Intranet. This is similar to the RCMP INFOWEB, except that it seems to be more about convincing the CBSA employee that they're doing the right thing, where I haven't seen anything like this from a document from INFOWEB. This seems to be a rough survey of all of ATLAS, and has information from the Intelligence and Targeting Operations.

The main document that we have is the CBSA Enforcement Manual. The manual is 1270 pages in length and is what the CBSA enforcement officers have to read. This is an extremely large manual and there is currently no text search available, which makes this difficult to read. That being said, it seems that both hate literature and obscenity are part of the Intelligence Section. This isn't as clearcut as it sounds, since the sections are really vague and fucked up, as well as the obvious. For example, the CBSA is mandated to prevent goods of a treasonous nature or goods of a seditious nature, which can include certain pieces of Anarchist literature. In addition to this, there is the fact that under the Criminal Code the CBSA is out to prevent obscenity from entering into Canada. However, it doesn't state what obscenity is exactly. It does cite the Little Sister's Bookstore Supreme Court of Canada case.

There are intelligence reports featuring the MV Sun Sea, the importation of Khat, and other border enforcement information. The last file is about the CBSA complaints system, or lack of complaints system. What's strange is that it's comparing something called the IG to SIRC. For those of you who don't know what SIRC is, SIRC is the Security Intelligence Review Committee, and the mandate of SIRC is to review the Canadian Security Intelligence Service (CSIS).

Given that it's 2012, and that very few people use film, I wanted to see the JPEG photos of myself under surveillance. I requested this under the Privacy Act and I got back the following photos in TIFF format:

The first photo is clearly from the 2010 Heart Attack demo. I know this because I remembered what shirt I wore that day. You can tell that it's before the demo because of the fact that the person next to me appears to be drinking a coffee, most likely from the nearby Starbucks. Furthermore, you can see other protesters with coffee with their faces blocked out so that Normand Sirois, the ATIP Analyst who imported/manipulated the images can protect their identities.

Wait, how did I know that these were not the original source photos? Easy, the first thing I did was look for the metadata associated with the TIFF using tiffinfo:

Today, I received four things in the mail. Three of those things were letters from CSIS indicating that they did get my cheques and that I will one day get a response from them of some sort. The fourth was a CD from the Vancouver Police Department with the information from the Olympic Tent Village protest. This includes a series of General Occurrence reports filed by the VPD, as well as the Operations Plan for the protest, which was done a month ahead of time.

It appears that in the introduction, the VPD is using "Open Source reporting", which as we know is fancy police talk to "We looked it up on the Internet", and it mentions the group VAN-ACT. Unfortunately, the Threat Assessment appears to be brief, but we will never know what it says, because the VPD redacted it under FIPPA because it may be harmful to the VPD. I don't know what the success rate is of challenging the VPD on this, but I'm guessing that if it's anything like the RCMP, it's not very good.

What's interesting is the enforcement policy of the Vancouver Police Department in this case. It seems clear that the VPD considered the occupation of land owned by the City of Vancouver to be a criminal action. The next section of the enforcement policy is withheld because of the fact that it is bound in lawyer-client privlege. However, what we do see is that the VPD asked and received Trespass Act Designation from Ernst and Young as well as from the Salt Corporation a month before the action occurred in case the people looking to set up on an abandoned lot.

The reason I requested this information was to get a standard baseline as to what happens when someone normally tries to do an Occupy-style protest in Vancouver. The report was done in January of 2011, which indicates to me that something caused the Olympic Tent Village to be taken seriously before that date. It would be good to see the OccupyVancouver operational plan, which is what I'm going to be requesting from the VPD next.
